Rule issued over shackles of opposition leader at hospital

The High Court on Monday issued a rule asking why using shackles during the treatment of Jashore Jubo Dal leader Aminur Rahman should not be declared illegal.
The court also ordered for arranging his treatment at Bangabandhu Sheikh Mujib Medical University (BSMMU) within 10 days.

 

The HC bench of Justice Mustafa Zaman Islam and Justice Md Atabullah passed the order after hearing on a writ challenging the legality of shackles use during treatment.
On Sunday morning, Nahida Sultana, wife of sick Jashore Jubo Dal vice president Md Aminur Rahman, filed the writ seeking direction for better treatment to her husband.
A photograph of the arrested opposition leader at the National Heart Institute in Dhaka went viral on social media on November 28 that drew widespread criticism from various quarters.

He was arrested in Jashore under a Special Powers Act case.

In the viral photo, he is seen lying on the hospital floor, his legs shackled, with handcuffs hanging from one hand.
Senior lawyer AJ Muhammad Ali brought the matter to the attention of a HC bench on Wednesday (November 29) after a news over it was published. He sought a suo moto (spontaneous) rule from the HC.
At one stage, the bench said criminals are usually put on shackles in the cases of serious crimes, including militancy. There are several decisions of the High Court in this regard. There are guidelines on which cases an accused can be worned shackles.
Aminur Rahman Madhu is the vice president of Jashore Jubo Dal.
